Divorce
There are two ways to dissolve a marriage. The first one is on a voluntary basis in the registry office upon a joint application. This is possible if both spouses agree, there are no minor children and there is no dispute about property and children. In all other cases, divorce occurs through the court. The husband does not have the right to dissolve the marriage without the consent of the spouse during pregnancy and the first year of the child’s life.
Property division
You can divide the property voluntarily by mutual agreement. But it is recommended to conclude an agreement on the division of jointly acquired property. Also, the division of property takes place in court as part of the divorce proceedings, or within 3 years after the dissolution of the marriage. According to the law, all property acquired in marriage is divided in half. There are exceptions to this rule.
Disputes about children
Disputes about children are the cornerstone of family law, and for good reason. Questions arise where and with whom a child can live upon dissolution of marriage, in what order parents can communicate with him, and also whether his grandparents have the right to communicate with the child. We must not forget that, according to the law, the parents, grandparents of the child have the right to communicate with the child. In any case, if their rights to communicate with a child are violated, you can go to court and defend your rights.
Deprivation of parental rights
Deprivation of parental rights of mother and father is an extreme legal measure of responsibility, which is applicable only in exceptional circumstances in a judicial proceeding. Family law states that a child cannot be separated from his parents. However, in case of child abuse, lack of educational measures, etc., the court decides to deprive the parent of parental rights or restrict parental rights.
Collection of alimony
By law, parents are required to support their minor children, and children are also required to support their parents in certain cases. Parents are obliged to support their disabled adult children who need help. Also, the court may oblige parents to participate in additional expenses for children. We must also not forget that adult children are obliged to support and take care of their disabled parents who need help, and the court may oblige children to bear additional expenses for their parents. Alimony can be collected both in a fixed amount of money and as a percentage, depending on the number of children and income. Spouses are entitled to receive alimony after the dissolution of the marriage. Marriage is not necessary for the recovery of alimony.
Marriage contract
A prenuptial agreement is an agreement concluded in writing between two people entering into marriage or already married, which defines their rights and obligations, both in marriage and in the event of its dissolution.
